2/3~2/7の在宅勤務について
現時点の上海市の規定によれば、2月9日24時前の業務再開は禁止されます。一方、業務再開の後回しは企業及び社会の正常な運行にも不利な影響を与え得るため、上海市は企業による在宅勤務措置を推奨しています。では、在宅勤務について以下のとおりにご提案させていただきます。
1．一部の従業員に対して在宅勤務をさせても構いません。
一部の業種（生産現場の労働者）は現場勤務でなければ業務が進みません。オフィスで働く者（オフィス勤務）は客観的に在宅勤務が可能であるため、会社は必要性に応じて従業員と意思疎通のうえ、従業員に在宅勤務をさせることができます。
2．在宅勤務の場合は代償を支払う必要があるか。
在宅勤務の場合、会社は残業代を支給するか、代休を与える必要があります。上海市の関連当局の解読によれば、2/3~2/7は休日とみなされ、通常出勤時の賃金を支給されます。勤務をさせた場合は残業代を支給するか、または代休を与える必要があるとのことですが、これに対し、当事務所は意見を保留します。理由は、休日扱いであれば、法に基づいて休日は賃金が計上されないため、賃金の支給も必要がないはずです。政府から未だ明文の規定がなく、特別な時期にある以上、政策の変化もあり得ると思います。企業にとっては、経済的な負担を減らすために、先ずは代休扱いが良策かもしれません。
3．在宅勤務を断わる従業員への処分はご慎重に。
断る理由を判明すべきであり、特に隔離中、観察中の従業員に対する懲戒処分は控えましょう。
4．在宅勤務と何もせずに給料をもらう人とは状況が違う。
在宅勤務を推奨し、公平性を保つために、在宅勤務を昇進や賞与の査定と連動するなど、会社は実際の状況にあわせて関連の政策を確立すべきです。
